Probate of Will
What if a person dies without a notarized Will?
There are two types of non-notarized Wills: the holographic Will and the Will made before witnesses. These Wills are recognized by law provided they comply with all the rules surrounding their drafting.
However, the law provides that upon death, the validity of the unnotarized Will must be verified by a notary or by the court.
Your notary Will take all the steps required by law for the probate of an unnotarized Will.
Appointment of a tutor to a minor child
Who will take care of your children?
In the event of the death or incapacity of the parents, or when the latter are unable to exercise their parental roles, a person must be appointed to exercise parental responsibilities.
It is possible for parents to appoint a tutor to their children in advance, by providing for it in a Will or in a protection mandate. If the parents have not foreseen this eventuality, your notary will be able to accompany you and carry out the necessary administrative and legal procedures to appoint a tutor for the minor child in order to ensure his protection as quickly as possible.
