Protection Mandate

What if one day you were no longer able to take care of yourself?

A protection mandate allows you to express your wishes concerning various subjects, in particular:

  • Who will take care of you and how?
  • Who will take care of your children?
  • Who will manage your finances and assets?

If one day you were no longer able to take care of yourself, without having made a protection mandate, the court will appoint the person who will be responsible for looking after you and your property. All the actions of this person will be subject to the supervision of the Curateur public and a tutorship council. Such procedures generally generate long delays and much higher costs than those related to the preparation of a protection mandate by a notary.

Homologation of the protection mandate

Have you been appointed mandatary to a disabled person?

Following the medical assessment, the protection mandate must be homologated.

The homologation is the process by which the court establishes the person’s incapacity and gives full effect to the protection mandate so that it can be used.

Your notary will assist you with the administrative and legal procedures necessary to obtain a judgment to homologate the protection mandate. He will prepare and present the request to the court so that you can take care of the disabled person as quickly as possible.
